Illinois Appellate Court Affirms that IEPA Cannot Allow Harmful Pollution

The Illinois Third Appellate District has affirmed the state’s Pollution Control Board decision that Illinois EPA could not grant a permit to the Village of New Lenox to increase its pollution of Hickory Creek without ensuring that it would not harm the creek and that alternatives to allowing the new pollution had been properly considered. The ruling should prevent Illinois EPA from allowing new pollution from coal mines, refineries, growing municipalities and other dischargers across Illinois. The decision may also serve as an important precedent for other states that are developing or just beginning to implement rules to prevent degradation of our waters.
