ELPC Thinks: Modernizing the Great Lakes Compact’s Administrative Standards to Be Resilient

The Great Lakes Compact is a Congressionally-approved agreement between eight U.S. states – Illinois, Indiana, Michigan, Minnesota, New York, Ohio, Pennsylvania, and Wisconsin – to protect, conserve, and manage Great Lakes waters.

Many of the guidances and regulations were written before today’s mounting pressures from climate change, water scarcity, and political uncertainty. Moreover, the U.S. Supreme Court’s decisions in Loper and other cases have changed governing administrative law principles.
