ELPC Thinks: Our Lawsuit Challenging EPA’s Repeal of the Endangerment Finding, & the SCOTUS Tariffs Decision 

There’s a lot of breaking news from the courts. ELPC, public health, and environmental group partners filed a petition to review the U.S. EPA’s repeal of the foundational Endangerment Finding, a science, evidence-based standard for regulating greenhouse gas pollution under the Clean Air Act. That appeal to the D.C. Circuit will likely end up before the U.S. Supreme Court.

The U.S. Supreme Court just issued a decision striking down the sweeping tariffs that President Trump imposed through a series of executive orders. The Court’s lead opinion held that tariffs violated the “major questions” doctrine – which began in the West Virginia v. EPA decision involving greenhouse gas pollution regulations. This decision could also affect the Trump administration’s legally dubious authority to declare an “emergency” under the Federal Power Act in order to justify requiring otherwise uneconomic coal plants to keep running.
