EPA’s Proposed Repeal of the Endangerment Finding and Clean Vehicle Standards Is Contrary to Law, Sound Science, and Common Sense

WASHINGTONU.S. EPA Administrator Lee Zeldin proposed to repeal the federal “Endangerment Finding,” as well as clean car, and clean truck standards. These statutory, science-based determinations require EPA to set greenhouse gas reduction standards applicable to power plants, vehicles, and other industrial sources under the Clean Air Act.

STATEMENT BY HOWARD LEARNER, CEO AND EXECUTIVE DIRECTOR, ENVIRONMENTAL LAW & POLICY CENTER

“The EPA’s action today trumps political ideology over statutory law, sound science, and common sense. It should be withdrawn before it is reversed by the courts on appeal. Here in the Midwest, we’re seeing the consequences of a warming world: extreme heat and erratic weather, toxic algae blooms, and more threats to our Great Lakes. EPA is creating uncertainty for businesses and people by proposing to repeal the evidence-based Endangerment Finding while, at the same time, climate change reality is harming public health, our environment, and our economy.”

“Climate change is real and accelerating. The Trump administration’s legal tower of babble for its clean air, clean cars, and trucks rollbacks will collapse into a pile of rubble if its flimsy basis for undoing the science-based Endangerment Finding is declared unlawful by the courts as it should be.”

“This Trump EPA action is based on the legal nonsense that CO2 and other greenhouse gases do not substantially contribute to climate change. Of course, they do. And of course, climate change is real as the hotter summer weather, Texas floods, California and Canada wildfires, and Florida hurricanes are making painfully clear to all.”

“ELPC will challenge the EPA’s misguided actions. We will first engage before EPA in its regulatory process, and then go to court if unfortunately necessary to reverse the EPA’s damaging actions.”
